AVENIR TELECOM attaches great importance to the protection of your private life. This is why we have adopted common principles within our Privacy Policy.

AVENIR TELECOM, a French limited company, headquartered in Marseille (13014), 208 Boulevard de Pluieres, is responsible for the processing of your personal data. The purpose of this document is to inform you how we use and protect your personal data, as well as the reasons why we process this data.

It applies uniformly to all services provided by the company AVENIR TELECOM, it being specified that additional information may be sent to you if necessary in the case of a particular order.

Your Energizer smartphone has an embedded Android operating system and a set of ancillary software such as Google Services and Google Mobile Applications. These programs are designed by Google and are subject to Google's own privacy policies and terms of use. You can view them within each of these mobile apps. Your smartphone also has other mobile apps, whose privacy policies and terms of use can be seen when inside these apps.

 

I. WHAT PERSONAL DATA DO WE PROCESS?

The collection of personal data is limited to what is strictly necessary (data minimisation principle)

We only collect and use the personal data that we need in the course of our business to offer you personalised and quality products and services.

We may collect different categories of personal data from you, including:

  • identification and contact information (last name, first name, postal and email address, telephone number, gender and signature);
  • identification and authentication data, especially if you use our services (technical logs, computer traces, security information, IP address);
  • information about your job (role);
  • data relating to interactions with us on our websites, on our applications, on our pages, on social networks, during interviews and telephone or video conversations and in e-mails);

We are in no way required to collect sensitive data.

The data we use may be collected directly from you or obtained from the following sources for the purpose of verifying or enriching our databases:

  • publications/databases made accessible by official authorities (official newspaper);
  • service providers;
  • third parties such as commercial information organisations in accordance with data protection regulations;
  • internet sites/directories/databases/social media pages containing information that you have made public or which has been made public by third parties.

In addition each form states in particular:

  • What the objectives of the collection of this data are (purposes);
  • Whether this data is mandatory or optional for the management of your request;
  • Who will be able to see it (only AVENIR TELECOM in principle, except when the form specifies that data needs to be shared with a third party in order to process your request);

II. DATA COLLECTION SPECIAL CASES, ESPECIALLY INDIRECT COLLECTION

AVENIR TELECOM may collect information about you although you are not a customer. The list below (non-exhaustive) shows examples of personal data collected by AVENIR TELECOM from non-customers, such as:

  • prospects,
  • principals or beneficiaries in transactions that have been made relating to a customer;
  • employees of our service providers.

III. WHY AND ACCORDING TO WHAT PROCESSING CRITERIA DO WE USE YOUR PERSONAL DATA?

A. TO COMPLY WITH OUR LEGAL AND REGULATORY OBLIGATIONS

We use your personal data to carry out various legal and regulatory obligations.

B. TO FULFIL A CONTRACT MADE WITH YOU OR PROVIDE PRE-CONTRACTUAL INFORMATION

We use your personal data to make and fulfil our contracts, including:

  • providing you with information about our products and services;
  • assisting you alongside your requests;

Within the context of customer relationship management including:

  • management and execution of products and services;

IV. TO WHICH ORGANISATION CATEGORIES CAN YOUR PERSONAL DATA BE DISCLOSED?

The personal data collected as part of the services offered by AVENIR TELECOM is processed according to secure protocols and enables AVENIR TELECOM to manage the data received within its computer applications. For the aforementioned purposes, we are required to disclose your personal data only to:

  • service providers and subcontractors providing services on our behalf;
  • independent agents, intermediaries,
  • commercial partners,
  • financial, judicial or state agencies, public bodies on request and to the extent permitted by the regulations;
  • certain regulated professions such as lawyers, notaries, auditors.

Your data may nevertheless be shared with or viewed by third-party companies (subcontractors) which are used by AVENIR TELECOM in connection with the performance of certain services and orders placed via the site, such as:

  • the service provider responsible for the operation of the Sites,
  • the provider responsible for hosting them,
  • the service provider responsible for preparing the order and dispatching it,
  • the supplier responsible for transporting the products that were ordered or are to be repaired,
  • AVENIR TELECOM's bank and/or its payment service provider,
  • customer service providers, including repair centres,
  • the provider responsible for sending newsletters.

 

SPECIAL CASE FOR THE PROTECTION OF MINORS' PRIVACY:

The Sites are not intended for minors. Nevertheless, access to the Sites is not restricted to majors only since there is no content on them that would be prohibited for under-18s.

The Sites do not aim to collect the personal data of minors.

However, if a minor's information is collected, the legal representative of said minor will have the option of contacting AVENIR TELECOM to rectify, modify or delete this information.

 

 

V. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We keep your personal data for the longest period of time needed for compliance with the applicable legal and regulatory provisions or for another period of time due to operational constraints. In terms of customers, most of the information is kept for the duration of the contractual relationship and for 10 years after the end of the contractual relationship.

Prospects' information is kept for 3 years from collection or from our last contact with you.

VI. WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM?

In accordance with the applicable regulations, you have various different rights, namely:

  • Right of access: you can obtain information concerning the processing of your personal data as well as a copy of this personal data.
  • Right of rectification: if you believe that your personal data is inaccurate or incomplete, you can demand that your personal data be modified accordingly.
  • Right to deletion: you can demand that your personal data be deleted within the limits of what is permitted by the regulations.
  • Right to the limitation of processing: you can request that the processing of your personal data be limited.
  • Right of opposition: you can oppose the processing of your personal data, for reasons connected to your personal circumstances. You have the absolute right to oppose the processing of your personal data for the purposes of commercial prospecting, including profiling related to this prospection.
  • Right to the portability of your data, when this right is applicable, you have the right to insist that the personal data you have provided us with is returned to you or, where technically possible, transferred to a third party;
  • Right to set guidelines for the storage, deletion or sharing of your personal data, applicable after your death.
  • Right to withdraw your consent: if you have consented to your data being processed, you have the right to withdraw your consent at any time.

AVENIR TELECOM offers internet users who no longer wish to receive the Newsletter the option of unsubscribing, by clicking on the link provided for this purpose in one of the newsletters, via their customer account or by contacting AVENIR TELECOM via following address "commercial.contact@energizeyourdevice.com" and specifying the email address to be unsubscribed.

WHAT IS IT?

The data you enter in the application forms for an offer enable AVENIR TELECOM to process your application.

WHAT DATA IS INVOLVED?

Title, last name, first name, email address, landline and mobile phone number, date of birth, country of residence, mailing address, post code, city, password, CV, application letter, comments, title of positions you are applying for.

HOW LONG IS DATA IS KEPT?

Unless you object, your data will be stored for 24 months and then made anonymous or deleted.

LOCATION OF DATA

This data is hosted on servers located in European Union territory.

  • Software update

WHAT IS IT?

If your phone has an internet connection, AVENIR TELECOM will process your IMEI number to see if software updates are available for your phone. On your first connection to the internet, if applications are available for your phone, they will be downloaded and installed. The activation date of your phone will also be collected, in order to calculate how long your phone's guarantee is valid in the event that you do not keep your purchase invoice.

HOW LONG DATA IS KEPT

 

Your IP address will not be retained.

SHARING WITH THIRD PARTIES

The activation date of your phone will be shared with the following AVENIR TELECOM subcontractors:

  • the manufacturer of your phone
  • service providers providing after-sales services (hotline, repair centres) if you send your phone for repair

In accordance with the applicable regulations, you are entitled to lodge a complaint with the competent supervisory authority such as the CNIL (the French Data Protection Authority) in France.

Because the world is undergoing continuous technological changes, we need to regularly update this information document. We invite you to read the latest version of this document on our internal site and we will inform you of any substantial changes through our sites or our usual methods of communication.

The purpose of this charter (hereinafter referred to as the "Charter") is to inform users of the sites:

Each form restricts the collection of personal data to what is strictly necessary (data minimisation principle) and states in particular:

E. MANAGEMENT OF COOKIES

The Site users are informed that when they view the Sites, cookies are stored on their computer, their mobile phone or their tablet.

The first time that users browse the Sites, a banner appears describing the specific purposes for which cookies are used and the option that users have of opposing these. The banner also informs them that if they continue to browse the Sites it means that they consent to the storage and use of cookies on their device. Accepting these cookies is a necessary condition for use of the Sites, if the Site users decline them then AVENIR TELECOM will not be able to ensure that users will be able to navigate the Sites properly.

Functionality cookies:

These are designed to enable use of the various functionalities of the Sites and to improve their operation.

These cookies do not collect information that can identify Site users. All the information that these cookies collect is anonymous and only used to improve the functionality of the Sites.

Analytics cookies:

These allow AVENIR TELECOM to recognise users, count how many there are and to look at the way they move around the Site. This allows AVENIR TELECOM to improve the functionality of the Sites, for example, by ensuring that Site users easily find what they are looking for. These cookies do not collect any information that would identify them. All information collected by these cookies is anonymous and only used to improve the functionality of the Sites.

The Site uses Google Analytics cookies. The information collected by Google Analytics cookies will be shared with and hosted by Google on servers located in the United States of America in accordance with their privacy policy. Advertising cookies:

These are the cookies used to show adverts or to target you with information suited to your interests on our site or outside our site when browsing the internet. They are used to reduce the number of times you see a particular advert and help measure the effectiveness of an advertising campaign.

Declining these advertising cookies has no impact on the use of our site. However, declining advertising cookies will not prevent you from seeing adverts on our site or on the internet.

This will only result in an ad that does not reflect your interests or preferences. These cookies are mainly third-party cookies. These cookies mainly depend on the advertising agencies. AVENIR TELECOM is unable to list them exhaustively.

Redirection partner tag cookies:

These cookies are used to identify Site users in order to show ads appropriate to their interests on third party sites and direct them to the third party distributor who is selling the product they are looking for in their store or on the internet.

Deactivation, settings, deletion and expiration of cookies:

Site users may deactivate or change the settings of their cookies by clicking on the "Cookie Management" tab on the Site.

However, if they decide to disable all cookies through their browser settings, including the Site functionality cookies (e.g. cookies enabling the saving of basket contents or that enable logging in to their account), it is very likely that they will no longer have access to all or part of the Sites.
